class=\"post-1074 page type-page status-publish hentry\"><\/article>\n<p><strong style=\"text-align: justify;\">NEW REGULATION ON THE REGISTRATION OF BIRTHS OF MINORS BORN TO ITALIAN PARENTS<\/strong><\/p>\n<div class=\"col-lg-8\" style=\"text-align: justify;\">\n<article class=\"post-1074 page type-page status-publish hentry\">Following the conversion of Decree Law No. 36\/2025 into Law No. 74 of 23\/05\/2025, Italian citizenship <strong>is transmitted to minors born abroad<\/strong>\u00a0only if <span style=\"text-decoration: underline;\">one of the conditions<\/span> listed below is met.<\/article>\n<\/div>\n<article><\/article>\n<article><\/article>\n<article><\/article>\n<article><\/article>\n<div class=\"col-lg-8\" style=\"text-align: justify;\">\n<article><strong>CASE 1)<\/strong><\/article>\n<article class=\"post-1074 page type-page status-publish hentry\"><strong>The minor <u>does not possess nor is eligible to obtain<\/u> any other citizenship, meaning <u>they are exclusively an Italian citizen.<\/u><\/strong><\/article>\n<article class=\"post-1074 page type-page status-publish hentry\">A minor is considered to possess another foreign citizenship if they:<\/p>\n<ul>\n<li>Acquire it <em>iure sanguinis<\/em> (by descent) from one of the parents;<br \/>\nAcquire it <em>iure soli<\/em> (by birthright), for example, minors born in the United Kingdom to parent(s) holding settled status;<br \/>\nAcquire it through a mere declaration without the possibility of refusal by the competent foreign authority (e.g., \u201ccitizenship by option\u201d for children born abroad).<\/li>\n<\/ul>\n<p><strong>EXAMPLES for the United Kingdom:<\/strong><\/p>\n<ul>\n<li>Both parents are exclusively Italian and have not met the residency requirements to obtain Indefinite Leave to Remain or Settled Status;<\/li>\n<li>One parent holding <strong>exclusively<\/strong> Italian citizenship, who <span style=\"text-decoration: underline;\">has not yet met the required years<\/span> of residence to obtain I<strong>ndefinite Leave to Remain or Settled Status<\/strong>, and the other parent with neither Italian nor British citizenship, whose nationality does not allow citizenship by descent (iure sanguinis) to a child born in a third country.<\/li>\n<\/ul>\n<p><a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/stato-civile\/come-registrare-una-nascita-in-italia\/case-1-minor-with-exclusive-italian-citizenship-documentation-to-submit\/\"><strong>Required documentation for Case 1)<\/strong><\/a><\/p>\n<p><strong>IMPORTANT:<\/strong> If Case 1 <strong>does not apply<\/strong>, the application may be submitted <strong>based on one of the two cases outlined below<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CASE 2)<\/strong><br \/>\n<strong>The parent who is an <span style=\"text-decoration: underline;\">Italian citizen since birth<\/span> resided in Italy for <span style=\"text-decoration: underline;\">at least 2 consecutive years prior to the child\u2019s date of birth;<\/span><\/strong><\/p>\n<p><strong>Or<\/strong><\/p>\n<p><strong>The parent acquired Italian citizenship (through naturalization, etc.) and resided in Italy for at least two consecutive years after acquiring citizenship and before the child\u2019s date of birth.<br \/>\n<\/strong>Residence in Italy prior to acquiring Italian citizenship can not be considered, nor can be considered the residence in Italy of the foreign parent.<\/p>\n<p><strong>(IMPORTANT:<\/strong> If Case 2 applies, <strong>it is not necessary to follow the instructions related to Case 3<\/strong>, which require additional documentation.)<\/p>\n<p><a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/stato-civile\/12033-2\/case-2-italian-citizen-parent-who-resided-in-italy-for-two-years-prior-to-the-childs-birth-documentation-to-submit\/\"><strong>Required documentation for Case 2<\/strong><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><strong>CASE 3)<\/strong><br \/>\n<strong>At the time of the child\u2019s birth, a parent or grandparent held (or held at the time of death) exclusively Italian citizenship.<\/strong><\/p>\n<p><strong>(IMPORTANT:<\/strong> Before referring to Case 3, which requires additional documentation compared to the previous cases, <strong>verify that the requirements for Case 2 do not apply).<\/strong><\/p>\n<p><strong><a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/stato-civile\/12033-2\/case-3-parent-or-granparent-with-exclusive-italian-citizenship-at-the-time-of-the-minors-birth-documentation-to-submit\/\">Required documentation for Case 3<\/a><\/strong><\/p>\n<\/article>\n<p>&nbsp;<\/p>\n<p><strong>CASE 4)<\/strong><\/p>\n<p><strong>Acquisition of Citizenship by Law<\/strong><br \/>\nIf the minor does not fall under any of the categories listed above (CASE 1, CASE 2, CASE 3), they are not \u201cautomatically Italian\u201d. However, <strong>minor children of at least one parent who is an Italian citizen by birth<\/strong> (<em>iure sanguinis<\/em>) may meet the requirements for acquiring citizenship by law (Art. 4, paragraph 1\u2011bis, Law no. 91 of 5 February 1992, and Art. 1, paragraph 1\u2011ter, Decree-Law 36\/2025).<br \/>\nPlease refer to the \u201c<a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza\/alternative-law-provisions-for-minor-children-who-do-not-automatically-acquire-italian-citizenship-by-descent\/\"><strong>CITIZENSHIP<\/strong><\/a>\u201d page for further information.<\/p>\n<article class=\"post-1074 page type-page status-publish hentry\">****It is strongly recommended to submit the request for registration of the birth certificate <strong>only if in possession of all the necessary documentation to verify the right to Italian citizenship<\/strong>. Please note that the request to register the minor\u2019s birth certificate in Italy also constitutes a request for recognition of Italian citizenship.<strong><u>This Consulate reserves the right to request additional documentation<\/u><\/strong>. In such cases, applications deemed incomplete will be rejected with a formal <strong>notice of denial pursuant to Article 10-bis of Law 241\/1990<\/strong>, after which <u>the applicant will have 10 days to submit any observations or supplementary documentation.<\/u>________________________________________________<\/p>\n<p><strong>REQUIREMENTS FOR REGISTRATION<\/strong><br \/>\nTo request the registration of a birth, ALL of the following requirements must be met:<\/p>\n<ul>\n<li><strong>Residence within the jurisdiction of this Consulate:<\/strong> At least one parent must reside in one of the following areas: Southern England, Wales, the Channel Islands, Gibraltar, the Territories of South Georgia and the South Sandwich Islands. Residents in the jurisdictions of <u>Manchester and Edinburgh<\/u> must contact the relevant Consular Offices for their territory (LINK: <a href=\"https:\/\/conslondra.esteri.it\/en\/chi-siamo\/la-rete-consolare\/\">Check your relevant Consulate \u2013 The Consular Network<\/a>).<\/li>\n<li><strong>Updated residential address:<\/strong> <u>The residential address declared in the application MUST MATCH the last address communicated to the Consulate<\/u>. To verify your address in the consular database, log into your profile on Fast.it (LINK: <a href=\"https:\/\/serviziconsolari.esteri.it\/ScoFE\/index.sco\">The portal for consular services<\/a>). To update your residential address, follow the procedure indicated in the A.I.R.E. section (LINK: <a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/aire\/\">AIRE \u2013 2. Address update<\/a>).<\/li>\n<li><strong>Italian citizenship and A.I.R.E. registration:<\/strong> At least one parent must be an Italian citizen registered with the Registry of Italians Residing Abroad (A.I.R.E) (LINK: <a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/aire\/come-iscriversi-allaire\/\">How to register with AIRE<\/a>).<\/li>\n<li><strong>Previous marriages\/divorces:<\/strong> If the minor was born after the parents\u2019 marriage, <strong>ensure that the marriage has been registered in Italy.<\/strong> For more information, visit the following LINK: <a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/stato-civile\/per-registrare-i-certificati-di-matrimonio\/\">How to register a marriage<\/a>; <a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/stato-civile\/per-registrare-una-sentenza-di-divorzio\/\">How to register a divorce decree<\/a>. If the marriage has never been registered in Italy before, <span style=\"color: #0000ff;\"><strong>the related registration request may be submitted in a single envelope together with the birth certificate registration request.<\/strong><\/span><strong>All marriages and any divorces must be registered in Italy.<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/article>\n<p><span style=\"text-decoration: underline;\">I<strong>MPORTANT NOTICE: <\/strong><\/span>For birth certificates<span style=\"text-decoration: underline;\"><strong> issued in the United Kingdom<\/strong><\/span>1. If the parents were <strong>NOT MARRIED<\/strong> at the time of the child\u2019s birth:<\/p>\n<ul>\n<li>The birth certificate <strong>must list both parents<\/strong>, Mother and Father, as <strong>informants<\/strong> (see section 12 \u201cInformant\u201d).<\/li>\n<li>If the certificate lists <strong>only one informant<\/strong>, either Mother or Father, a <strong>Declaration of Acknowledgment<\/strong> of the child born out of wedlock is required.<\/li>\n<li>This declaration can be obtained at the <strong>Notary Office of this Consulate<\/strong> (<a href=\"https:\/\/conslondra.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino\/notarile\/atti-di-riconoscimento-di-figli-nati-fuori-dal-matrimonio\/\">Riconoscimento figlio nato fuori dal matrimonio<\/a>)<\/li>\n<\/ul>\n<p>2. If the parents <strong>WERE MARRIED<\/strong> at the time of the child\u2019s birth:<\/p>\n<ul>\n<li>If the marriage has <strong>already been registered in Italy<\/strong>, the birth certificate may list <strong>only one informant<\/strong>, either Mother or Father.<\/li>\n<\/ul>\n<p>________________________________________________<\/p>\n<p><strong>HOW TO REQUEST REGISTRATION VIA THE CONSULATE<\/strong><\/p>\n<article class=\"post-1074 page type-page status-publish hentry\">Send the following via Royal Mail Special Delivery to:<strong>Consulate General of Italy in London<\/strong><br \/>\n<strong>Civil Status Office \u2013 Births Section<br \/>\n\u201cHarp House\u201d \u2013 83\/86 Farringdon Street<br \/>\nEC4A 4BL London<\/strong><\/p>\n<ul>\n<li>The request for registration;<\/li>\n<li>The required documents listed above;<\/li>\n<li>A second \u201cSpecial Delivery\u201d envelope, pre-paid with an undated stamp, with your address, for the possible return of applications that are not admissible.<\/li>\n<\/ul>\n<p>________________________________________<\/p>\n<p><strong>PROCESSING TIMES AND APPLICATION STATUS<\/strong><\/p>\n<p>The receipt of the application by the Consulate can be checked through the Royal Mail webpage <a href=\"https:\/\/www.royalmail.com\/track-your-item\">https:\/\/www.royalmail.com\/track-your-item<\/a>.<\/p>\n<p><strong>Please do not contact the Consulate to inquire whether the envelope has been delivered.<\/strong><\/p>\n<p>Upon arrival at the Consulate, the application is registered and assessed <strong>in accordance with the chronological order of receipt<\/strong>.<\/p>\n<p>If any documentation is incorrect or missing, the Civil Status Office will issue a \u201cnotice of intended refusal\u201d (<em>preavviso di diniego<\/em>), as provided for by Law 241\/1990. From the date of receipt, the parents will have 10 days to submit their observations. If these are not considered complete or satisfactory, the Consulate will issue a \u201crefusal decision\u201d (<em>provvedimento di diniego<\/em>).<\/p>\n<p>Processing times depend <strong>not only on the correct submission of the application and its attachments<\/strong>, but also on the <strong><span style=\"text-decoration: underline;\">citizenship and residency history certificates<\/span> that the Consulate must request<\/strong> from one or more municipalities (depending on the individual case). Please note that municipalities may take <span style=\"text-decoration: underline;\">a very long time to respond<\/span> to such requests.<\/p>\n<p>At the end of the procedure, once the Consulate send the request for the transcription of the birth certificate to the competent Municipality, <strong>an email notification will be sent to the parents (please also check the junk\/spam folder)<\/strong>. <span style=\"text-decoration: underline;\">Only at that point may the parents submit a passport application for the minor, if needed.<\/span><\/p>\n<p><strong>To request information regarding the status of the application<\/strong>, <span style=\"color: #0000ff;\"><strong>please wait at least <span style=\"text-decoration: underline;\">sixteen weeks<\/span><\/strong><\/span>before contacting the office.<\/p>\n<p>It is extremely important that <strong>the application be submitted complete with all required documents and with the correct indication of the applicable Case,<\/strong> in order to avoid returns or refusals that would further extend processing times for both your application and those of other applicants.<\/p>\n<p><strong>PLEASE NOTE: <\/strong>The birth certificates and all documentation submitted here <strong>must remain on file at the Consulate<\/strong> and therefore, once the request for transcription has been sent to the Italian &#8220;Comune&#8221;, <span style=\"text-decoration: underline;\"><strong>they will not be returned<\/strong><\/span>.<\/p>\n<p>___________________________________________<\/p>\n<p><strong>OUTCOME AND CONFIRMATION OF REGISTRATION<\/strong><\/p>\n<p><strong>The Municipality will register the certificate in its civil registry according to its internal processing times. In case of rejection, the Municipality will communicate the reasons to the Consulate via certified email (PEC), and the applicant will be informed of the negative outcome.<\/strong><\/p>\n<p>Once you have received a copy of the notification from the Consulate confirming the transmission of the certificate to the Municipality, the Consulate\u2019s obligations will be completed.<\/p>\n<p>For updates regarding the actual registration at the \u201cComune\u201d, you may:<\/p>\n<ul>\n<li><strong>Contact the relevant AIRE Municipality directly<\/strong>; email and phone contacts are available on the Municipality\u2019s homepage;<\/li>\n<li><strong>Check your personal registry record on the ANPR portal for updates<\/strong> (LINK: <a href=\"https:\/\/www.anagrafenazionale.interno.it\/\">ANPR<\/a>).
