Instructions – Documents to send:<\/strong><\/p>\n

    \n
  1. fill out and sign application form, \u2018Dichiarazione Sostitutiva dell\u2019Atto di Notorieta\u2019 – Form. n.12, (please click here to download form<\/a>);<\/li>\n
  2. attach a copy of your valid ID;<\/li>\n
  3. attach your divorce sentence (\u201cDECREE ABSOLUTE\u201d or “FINAL ORDER”<\/strong>) in original<\/span>, with the wording: \u201cI certify that this is a true copy of the original document filed with this Court\u201d<\/em> stamped and signed by a District Judge (or a similar declaration signed by a solicitor or a notary public).\u00a0<\/strong>This document must be\u00a0LEGALISED<\/strong> with a paper \u201cApostille<\/em>\u201c (e-apostille is not acceptable)<\/strong>, issued by the UK Foreign & Commonwealth Office (click\u00a0HERE<\/a>). The Apostille does not need to be translated<\/span>.<\/li>\n
  4. translation in Italian of the divorce sentence <\/strong>(please click here for a List of Certified Translators<\/a>). The translation does not<\/u>\u00a0require an Apostille.<\/li>\n
  5. In the case of a British divorce issued in digital format (PDF by email)<\/strong>, enclose the email with which you received the document by the Court. There is no need of apostille or translation<\/strong> of the accompanying email. What is stated in points 3 and 4 regarding the apostille on the Decree Absolute and the translation remains unchanged.<\/strong><\/li>\n
  6. Should there currently be minors, attach the \u201cAGREEMENT FOR CHILDREN<\/strong>\u201d in original,\u00a0with the wording: \u201cI certify that this is a true copy of the original document filed with this Court\u201d, <\/em>stamped and signed by a District Judge (or a similar declaration signed by a solicitor or a notary public). <\/strong>This document must be LEGALISED<\/strong>\u00a0with an \u201cApostille<\/em>\u201c, issued by the UK Foreign & Commonwealth Office (click\u00a0HERE<\/a>). The translation does\u00a0not<\/u> require an Apostille. Alternatively, if there was no \u201dagreement for children\u201d, you may present: a statement certifying that the Court had no intervention in respect of the children; proof of agreement between the parties in front of a British solicitor or agency recognized by the British government. Either of these documents must be LEGALISED<\/strong>\u00a0with an \u201cApostille<\/em>\u201c, issued by the UK Foreign & Commonwealth Office (click\u00a0HERE<\/a>), and present a translation in Italian <\/strong>(please click here for a List of Certified Translators<\/a>). The translation does not<\/u> require an Apostille. Otherwise, a statutory declaration in Italian on the appropriate form (click here<\/a>) confirming the above circumstances.<\/li>\n
  7. In the case of absence of one party (\u201cDefault of Appearance\u201d<\/strong>) and the person requesting the\u00a0 transmission is the \u201cPetitioner\u201d (attore): confirmation of notification to the Respondent (\u201cAcknowledgement of service\u201d<\/strong>) together with the abovementioned stamp of \u201ctrue copy\u201d,\u00a0<\/strong><\/strong>stamped and signed by a District Judge (or a similar declaration signed by a solicitor or a notary public).\u00a0<\/strong>This document must be\u00a0LEGALISED<\/strong>\u00a0with an \u201cApostille<\/em>\u201c, issued by the UK Foreign & Commonwealth Office (click\u00a0HERE<\/a>); and must be presented\u00a0with a\u00a0translation in Italian <\/strong>(please click here for a List of Certified Translators<\/a>).
