In order to register the British adoption of a minor in Italy, the adoptive parents must first obtain a recognition order, i.e. an order issued by an Italian Youth Court that recognises the British adoption order.
Applications can be submitted via this Notary Office, if at least one of the minor’s adoptive parents is an Italian citizen and has completed two years of residence in this Consulate’s catchment area to the date the British adoption order was issued. The institutions involved in the process will be the municipality of AIRE registration of the parent and the competent Youth Court (Tribunale per i Minorenni).
REQUIRED DOCUMENTS:
- Application form, filled in and signed;
- Adopted child’s full birth certificate, issued before the adoption.
- If the adopted minor was not born in the United Kingdom, the full birth certificate issued by the country of origin must be legalised and translated into Italian. Generally, legalisation must be in the form of an apostille, if the country has contracted the Hague Convention of 05.10.1961. If the country is not a signatory to this Convention, legalisation must be carried out by the competent Italian Embassy/Consulate for the issuing country. The translation into Italian, carried out by an official translator, must be certified by the competent Italian Embassy/Consulate or legalised with an apostille. Please visit the website of the competent Italian Consulate in the country that issued the certificate.
- If the adopted minor was born in the United Kingdom, the “full birth certificate” issued by the General Register Office must be presented. This document must be legalised with an apostille by the Legalisation Office and translated into Italian. Parents can translate the document themselves using the template offered here (No. 21).
- British birth certificate, issued after the adoption, legalised and translated into Italian (see point 2);
- British adoption order, legalised and translated into Italian (see point 2);
- Photocopies of the identity documents of the adoptive parents and the child.
