To register a divorce

Before the divorce can be transcribed the marriage needs to be registered.

Instructions:

SENTENCES PRIOR TO 31/12/2020:

  1. fill out and sign application form (“Dichiarazione Sostitutiva dell’Atto di Notorieta” Form n. 12) (please click here to download form);
  2. attach a copy of your valid ID;
  3. attach your divorce (“DECREE ABSOLUTE”) in original, together with a translation in Italian(please click here for a List of Certified Translators) and with the wording: “I certify that this is a true copy of the original document filed with this Court” stamped by a District Judge. In the case of a British divorce issued in digital format (PDF by email), enclose the covering note sent by the Court;
  4. attach the “AGREEMENT FOR CHILDREN” – should there be minors – in original, together with a translation in Italian(please click here for a List of Certified Translators) and with the wording: “I certify that this is a true copy of the original document filed with this Court” stamped by a District Judge.  Alternatively, if there was no ”agreement for children”, you may present: a statement certifying that the Court had no intervention in respect of the children; proof of agreement between the parties in front of a British solicitor or agency recognized by the British government; statutory declaration  confirming the above circumstances;
  5. attach Certificate Art. 39 – Form D180 original (please click here to download form – Form n. 13); this document must be completed by the applicant, dated, signed and sealed by the Court in original, with the wording: “I certify that this is a true copy of the original document filed with this Court” stamped by a District Judge. NO translation is required;
  6. only if the judgement was given in absence of the Respondent (“Default of Appearance”) and the person requesting the registration is the “Petitioner”: please attach “Acknowledgement of service”, translated in Italian(please click here for a List of Certified Translators) and with the above-mentioned stamp of “true copy” by the District Judge.

SENTENCES AFTER 31/12/2020:

  3. attach the provisional decree (“DECREE NISI”) in original,  together with a translation in Italian(please click here for a List of Certified Translators) and with the wording: “I certify that this is a true copy of the original document filed with this Court” stamped by a District Judge.  This document must be LEGALISED with an “Apostille“, issued by the UK Foreign & Commonwealth Office (click HERE); the translation does not require an Apostille.
  4. attach your divorce (“DECREE ABSOLUTE”) in original, together with a translation in Italian(please click here for a List of Certified Translators) and with the wording: “I certify that this is a true copy of the original document filed with this Court” stamped by a District Judge. In the case of a British divorce issued in digital format (PDF by email), enclose the covering note sent by the Court.   6. in the case of absence of one party (“Default of Appearance”) and the person requesting the  trasmission is the “Petitioner” (attore): confirmation of notification to the Respondent (“Acknowledgement of service”) with a translation in Italian (please click here for a List of Certified Translators) together with the abovementioned stamp of “true copy” by the District Judge.  This document must be LEGALISED with an “Apostille“, issued by the UK Foreign & Commonwealth Office (click HERE); the translation does not require an Apostille.

 Post all the above documents by Special Delivery to:

CONSOLATO GENERALE D’ITALIA – Ufficio Stato Civile – ‘‘Harp House’’ – 83/86 Farringdon Street – EC4A 4BL London. Please include a pre-paid Special Delivery envelope in case of return of documentation.

IMPORTANT INFORMATION:

  • In case of a divorce in countries other than the United Kingdom, a legalisation and translation of the divorce should be obtained. For both the legalisation and translation the appropriate Italian Consulate or Embassy located in the relevant country should be contacted (for instance : Bangladesh – Embassy of Italy in Dhaka). For a divorce obtained in Brasil, please consult information from the Italian Consulate in San Paolo,  for the required documentation for registration (click HERE).
  • IF THE DOCUMENTATION IS COMPLETE AND CORRECT AND THE APPLICATION CAN BE PROCESSED, THE ORIGINAL CERTIFICATES WILL NOT BE RETURNED.
  • Please be informed that in case of incomplete or incorrect documentation, the application will not be processed and the documentation will be returned to those who will have included a pre-stamped self-addressed envelope (Special Delivery) in the application, as mentioned above.
